These Terms of Service ("Terms") apply to the advertising agency services provided by Elephant Room Consulting Pty Ltd (Elephant Room, we, us, our) — ABN 93 168 298 888 — including our use of our advertising-automation tooling and our integrations with advertising platforms such as Meta (Facebook and Instagram), Google, TikTok, Pinterest, and Klaviyo.

These Terms apply to the businesses that engage us as their advertising agency and their authorised representatives ("you", "your"). We do not offer a consumer product, and no individual end users sign up for our services.

Your engagement agreement governs. Where you and Elephant Room have signed a separate engagement agreement — such as a Master Services Agreement or Statement of Work — that agreement sets out the commercial terms of our relationship (including fees, service scope, intellectual property, confidentiality, warranties, liability, and termination) and prevails over these Terms to the extent of any inconsistency. These Terms are a general statement of how our services and tooling operate; they are not the commercial contract.

1. Our services. We plan, build, manage, and report on advertising campaigns on the platforms you authorise us to manage on your behalf. Our tooling automates parts of campaign management — such as reading performance data, pacing budgets, and scheduling campaigns — at your direction.

2. Authorisation and access. You authorise us to access and act within your advertising-platform accounts on your behalf — for example by adding us as an agency partner in your Meta Business Manager or connecting our application to your Pinterest Business account. You may withdraw this authorisation at any time by removing our access through the relevant platform (see our Privacy Policy for the steps).

3. Your responsibilities. You are responsible for maintaining your own platform accounts, providing accurate information and authorisations, holding the rights to the content and data you provide to us, and your own compliance with each platform's terms and applicable law. You confirm you are authorised to grant us the access you give us.

4. Fees. Our agency fees are separate from, and additional to, the advertising spend you pay to the advertising platforms. The amount and payment terms of our fees are set out in your engagement agreement.

5. Platform compliance. We provide our services consistent with the terms of the platforms we operate on, including the Meta Platform Terms and the Pinterest Developer Guidelines. We access your accounts only with your authorisation and use information from your accounts only to provide services to you. For Pinterest specifically, we do not combine your information with other clients' information, use it to target people off Pinterest, or share it with any other advertising service. Elephant Room is an independent advertising agency and is not affiliated with, endorsed by, or sponsored by any advertising platform.

6. Consumer guarantees. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

7. Changes. We may update these Terms from time to time. The version in force is the one published at this URL, and its date appears at the top.
